WHEREAS, by Deed of Trust dated March 10, 2025, and recorded in the Clerk’s Office of the Circuit Court of Wise County, Virginia, by Instrument No. 202500863, Jeffery Scott Carter II, unmarried, conveyed to Dee Dee Hill, Trustee, the hereinafter described real estate to secure the payment of a note in the original principal amount of $88,000.00; and
WHEREAS, the undersigned was appointed and substituted as Substitute Trustee under this Deed of Trust by a substitution dated March 18, 2026, and recorded in Clerk’s Office of the Circuit Court of Wise County, Virginia, by Instrument No. 202601067; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Eastman Credit Union, the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Substitute Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof; and
WHEREAS, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for ten percent down with the remainder due at closing within 20 days of sale, at the main entrance of the Wise County Courthouse, 206 East Main Street, Wise, Virginia, at 10:00 a.m. on June 3, 2026.

All that certain tract, piece or parcel of land, together with improvements situate thereon and appurtenances thereto appertaining, located on the waters of Guest River in what is known as “Riverview” section, in the Lipps Magisterial District of Wise County, Virginia, and being more particularly bounded and described as follows, to-wit:
BEING Lot No. 5 of the John Count Estate, BEGINNING at a stake on the bank of Guest River at the mouth of the land or roadway; and with said roadway S 9 ½ E 91 feet to a stake; S 14 15 E 261 feet to a stake; S 51 30 W 77 feet to a stake in the land; S 71 40 W 131 feet to a stake; S 67 30 W 150 feet; S 41 30 1335 feet to a hub on the river; thence up said river N 24 35 E 195 feet to a stake N 23 24 E 243 feet to a stake; N 11 10 E 411 feet to a stake; N 20 W 223 feet to a stake; N 29 40 W 350 feet to a stake; N 65 04 W 182 feet to a stake; N 75 30 W 353 feet to a stake opposite the mouth of Tom’s Creek; N 82 W 125 feet to the BEGINNING, containing twenty (20) acres, more or less.

EXCEPTING AND RESERVING, NEVERTHELESS, from the operation of this conveyance a certain strip or parcel thereof containing 3.52 acres that was conveyed by S.S. Counts and wife Helen Counts to Interstate Railroad Company, Inc., dated the 28th day of May, 1921, and recorded in the Clerk’s Office in Deed Book No. 149, Page 513, etc.
THERE is also EXCEPTED from this conveyance such property or tracts of land conveyed to the following: (1) Dorma Hughes, (2) Harold Powers, (3) Ralph Blankenbeclor, (4) Delores Smith, which deeds are recorded in the Clerk’s Office of Wise County, Virginia, as mentioned in deed recorded in Deed Book 449, page 172.
THERE is also EXCEPTED from this conveyance a tract of land conveyed in Deed dated June 13, 2002, from Medol Eugene Smith to Ella Deloris Smith Green, recorded as Instrument Number 200202821.
There is also EXCEPTED from this conveyance a 3.51 acre tract and tracts of property conveyed to Dorma Hughes, Harold Powers, Ralph Blankenbeclor and Deloris Smith, as mentioned in Deed, recorded in Deed Book 449, page 172.
BEING that same property conveyed unto Jeffrey Scott Carter, II, by Deed dated March 10, 2025, from Jimmie Dean Ledington, Paula Rene Banks, Rhonda Carol Taylor, Alexis Eileen Keither, heirs of Joyce Karen Ledington, which said Deed is intended to be recorded simultaneously herewith in the Wise County Circuit Court Clerk’s Office, reference to which said Deed is hereby made.
THERE IS ALSO GRANTED to the Grantee the use of any and all easements, rights of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by Grantor, whether by express grant, prescriptive use or otherwise and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
THIS DEED IS MADE SUBJECT to any and all existing reservations, easements, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above described property.
THERE IS ALSO CONVEYED BY THIS INSTRUMENT all buildings, improvements, fixtures, appliances and/or easements, now or hereafter attached to or used in connection with the property herein-above described.

The sale will be made without covenant or warranty regarding title, possession, easements, restrictive covenants, or encumbrances, in bar of all rights and equity of redemption waived in the deed of trust, and subject to all unpaid real estate taxes and all other rights or exemptions of the grantors in said deed of trust.
