In execution of a certain Deed of Trust dated October 30, 2023, in the original principal amount of $125,000.00 recorded in the Clerk’s Office, Circuit Court for Wise County, Virginia as Instrument No. 202304554. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Wise County and the City of Norton, 206 East Main Street, Wise, Virginia, or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court, on July 1, 2026, at 3:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows:
ALL THOSE TWO CERTAIN TRACTS OF LAND, TOGETHER WITH ALL IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE TOWN OF APPALACHIA, COUNTY OF WISE, STATE OF VIRGINIA, ON THE NORTH SIDE OF MAIN STREET IN BLOCK 7 OF THE STALLARD REAL ESTATE COMPANY`S ADDITION TO THE TOWN OF APPALACHIA, SAID TRACTS BEING DESCRIBED AND RECORDED IN DEED BOOK 389 AT PAGE 192 AND BOTH TRACTS BEING MORE PARTICULARLY DESCRIBED BELOW, BY A CURRENT SURVEY, AS ONE TRACT: BEGINNING AT A DRILL HOLE IN THE SOUTHERLY END OF A ROCK WALL AND IN THE NORTHERLY LINE OF MAIN STREET, SAID DRILL HOLE BEING REFERENCES S 88 D 56` 02" W 555.52 FEET FROM A DRILL HOLE IN A ROCK WALL AT THE CORNER OF BELL AVENUE AND MAIN STREET; THENCE WITH THE NORTHERLY LINE OF MAIN STREET S 89 D 00` 00" W 100.00 FEET TO A DRILL HOLE IN A CONCRETE WALL, SAID DRILL HOLE BEING REFERENCED S 6 D 47` 24" E 5.80 FEET FROM AN IRON PIN FOUND; THENCE LEAVING MAIN STREET N 01 D 00` 00" W 125.00 FEET TO AN IRON PIN SET IN THE SOUTHERLY LINE OF A 20-FOOT WIDE ALLEY; THENCE WITH SAID LINE OF SAID ALLEY N 89 D 00` 00" E 100.00 FEET TO AN IRON PIN SET; THENCE LEAVING THE ALLEY S 01 D 00` 00" E 125.00 TO THE BEGINNING AND CONTAINING 12,500.00 SQUARE FEET OR 0.287 ACRE AND SHOWN ON A PLAT DATED JUNE 28, 1999, BY W.R. PALMER, REGISTERED LAND SURVEYOR.
TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. Additional terms, if any, to be announced at the sale and the Purchaser may be given the option to execute the contract of sale electronically.
