    Default having been made in the terms of a certain Deed of Trust dated June 10, 2017, in the original principal amount of $149,572.00 and recorded in the Clerk's Office of the Circuit Court of the County of Wise, Virginia on June 16, 2017, as Instrument Number 201702659, the undersigned Substitute Trustees will sell at public auction on June 08, 2026 at 12:00 PM, in front of the building housing the County of Wise Circuit Court, 206 East Main Street, Wise, VA 24293, the property designated as All that certain tract or parcel of land, lying and being situate in the Town of Big Stone Gap, Wise County, Virginia, and being more particularly bounded and described as follows, to wit: 
    Being Lots 2, 3 and 4 in Block 3 of Imboden Reservation Plat NO. 1, situated at 701 Wood Avenue in the Town of Big Stone Gap, Wise County, Virginia, and being farther bounded and described as follows: Beginning at an iron pin in the Western right of way of Wood Avenue, a common corner to Lot NO. 5; Thence with said Western right of way of Wood Avenue South 24 deg. 00 sec. West 90.00 feet to an iron pin, said pin bears North 24 deg. 00 min. East 45.00 feet from the intersection of said Western right of way Wood Avenue and the Northern right of way of Shawnee Avenue and being a common corner to Lot No. 1; Thence leaving said Western right of way of Wood Avenue and with said Lot No.1 North 66 deg. 30 min. West 117.09 feet to an iron pin, a common corner of Lots 6 and 7 of Block 2; Thence leaving said Lot No.1 and with said Lot No. 6 North 45 deg. 30 min. West 91.00 feet to an iron pin on the Eastern bank of Powell River; Thence leaving said Lot No. 6 and with said Eastern bank of Powell River North 38 deg. 01 min. 19 sec. East, 59.15 feet to an iron pin by a 6-inch beech and a 48-inch red oak, said pin being a common corner to the aforesaid Lot No. 5; thence leaving said Eastern bank of Powell River and with said Lot No. 5, South 66 deg. 36 min. East 188.00 feet to the beginning. Excepting therefrom all oil, gas, minerals, and other hydrocarbon substances lying below the surface of said land, but with no right of surface entry. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.      
    TERMS: CASH. A deposit of $15,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement. A Trustee's Deed will be prepared by Trustee's attorney at high bidder's expense.
