In execution of that certain Deed of Trust dated December 18, 2020 and recorded in the Circuit Court Clerk’s Office of Wise County, Virginia as Instrument Number 202005177, and by virtue of the authority vested in the undersigned Substitute Trustee, by said Deed of Trust, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:
All that certain lot or parcel of land, together with improvements thereon, situate, lying and being in the CITY OF NORTON in the State of Virginia, and bounded and described as follows, to-wit:

BEGINNING at a point being a point in the right of way of Park Avenue and U .S. #23 (Business) and the common corner of Trexes and Lot 4, also being a point in a curve with a radius of 1752.47’ and a Delta angle of 1°-00’-00” and a length of 30.59’; thence with the right of way of Park Avenue and U.S. #23 (Business) with a curve to the right and a radius of 1752.47’ and a Delta of 0°-35’-55” and a length of 18.31’ with a long cord of S 35°-02’-05” W 18.31’ to a point in the right of way of Park Avenue and U.S. #23 (Business); thence with a curve to the right and a radius of 1752.47 and a Delta angle of 4°-05’-12” and a length of 125’ and a long cord bearing S 37°-27’-36” W 124.9735’ to a point in the right of way of Park Avenue and U.S.#23 (Business), being the common corner of Lot 4 and Lot 5; thence leaving the right of way with a new line S 55°-40’ E 180.00’ to a point on line; thence S 55°-40’ E 127.56’ to a point in the center of Guest River, and being the common corner of Lot 4 and Lot 5, and being the right of way of Interstate Railroad; thence with the right of Interstate Railroad and center of Guest River with a curve to the left and a radius of 702.17’ and a Delta angle 2°-41’33” and a length of 32.9966’ and a long chord bearing of N 24°-59’-30” E 32.9936’ to a point in the center of Guest River and the right of way of Interstate Railroad; thence N 23°-39’ E 112.50’ to a point in the center of Guest River and the right of way of Interstate Railroad, said point being the common corner to Lot 4 and Trexes; thence with the common lien of Lot 4 and Trexes and leaving Guest River N 55°-40’ W 199.49’ to a point on line; thence N 55°-40’ W 175.00’ to the point of BEGINNING, containing 0.98 acre, more or less.
There is also granted to the Grantee the use of any and all easements right of ways, roadways, water rights, pipeline rights, sewer systems including any field lines attached thereto, in existence and which lawfully may be used by Grantor, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property hereby conveyed.
There is EXCEPTED and RESERVED, nevertheless, all the coal, oil, gas, mining rights and privileges which may have heretofore been sold, conveyed, excepted or reserved by prior deeds of record.
BEING the same property Castle Properties of Southwest Virginia, LLC acquired by deed dated December 18, 2020, from Huff & Sons, Inc., of record in the Circuit Court Clerk’s Office of Wise County, Virginia as Instrument No. 202005175.

TIME OF SALE: 10:15 a.m.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
