Default having been made in the terms of a certain Deed of Trust dated September 26, 2022, in the original principal amount of $126,736.00 and recorded in the Clerk's Office of the Circuit Court of the County of Wise, Virginia, in Instrument No. 202204485, the undersigned Substitute Trustees will sell at public auction on October 1, 2025, at 1:00 PM in front of the building housing the Wise County Circuit Court, 206 E. Main Street, Wise, VA 24293, the property designated as Tract No. 1: Beginning on a maple by the bank of Lick Creek in the Old Nash Line and with said creek, N 29 W 29 poles to a dogwood by the creek; thence S 77 E 46 3/4 poles to top of the ridge; thence with the top of the middle of the ridge, S 11 E 28 poles to a chestnut; thence N 73 W 39 poles to a maple, the beginning, containing 7 77/160 acres, more or less. Tract No. 2: Beginning at a stake on the lower or east side of Lick Creek, road number 628, thence running with the meanders of said road a distance of 650 feet to a stake on the lower side of said road, two small Lynn witnesses; thence running approximately east, crossing Lick Creek a distance of 51 feet to a maple; thence with a part of said line to the beginning, containing 1 1/2 acres, more or less. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises.
TERMS: CASH. A deposit of $12,500.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder’s deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 calendar days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee’s Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review on the Foreclosure Sales page of www.glasserlaw.com, outlining additional terms of sale and settlement. A Trustee’s Deed will be prepared by Trustee’s attorney at high bidder’s expense.
