    The object of this suit is to enforce the lien of the Complainant, County of Wise, Virginia, for delinquent real estate taxes against certain real property located in the County of Wise, Virginia, described as follows:

     All that certain tract or parcel of land, lying and being in the Town of Appalachia, Wise County, Virginia, and more particularly described as follows:

    Being Lot No. 7 and part of Lot No. 6, in Block No. 7, on a plat marked and known as “Plat Number Three of Wise Realty Corporation Addition to the Town of Appalachia, Virginia”, said part of Lot No. 6 being bounded as follows: Beginning at a point between Lot Nos. 6 and 7 on the southwest corner thereof on an alley, thence in a westerly direction 25 feet; thence in a northeasterly direction parallel with line between Lot Nos. 6 and 7 to Inman Street; thence with the said Inman Street to the intersection of Lot Nos. 6 and 7; thence with the line of Lot No. 7 to the beginning, being the eastern half of Lot No. 6 which adjoins Lot No. 7.

    Less and except the coal, oil, gas, minerals, and mineral substances of every kind and description in, over, and upon premises herein described, together with the right to use and enjoy the same in any manner which will not unreasonably interfere with the use and enjoyment of the surface as set out in Deed dated April 19, 1935.

    And being the same property conveyed to Lloyd C. Smith from Irene A. Stone, widow, by Deed dated February 15, 1958, and recorded March 4, 1958, in the Clerk’s Office of the Circuit Court of Wise County, Virginia, in Deed Book 342, at Page 177.

   The said Lloyd C. Smith died April 11, 1973, and pursuant to a List of Heirs dated and recorded June 12, 1973, in the aforementioned Clerk’s Office in Will Book 33, at Page 624, Lloyd C. Smith may have passed his interest in the above-described property to his wife and children, namely Ollie V. Smith, Patty Long, Darrell Smith, and Christopher Smith.

    And further being the same property conveyed to Kimberly Jean Cortez from Ollie V. Smith, widow, by Deed dated March 5, 2003, and recorded March 6, 2003, in the aforementioned Clerk’s Office as Instrument Number 200301013.

  This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described.

     IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Kimberly Jean Cortez, whose last known address is 3911 East Stone Gap Road, East Stone Gap, Virginia  24246; Patty Long aka Patricia A. Clay, whose last known address is 4908 Alsea Road, Wise, Virginia  24293; Darrell Smith aka Charles Darrell Smith, who is believed to be deceased and whose last known address is P.O. Box 271, Pound, Virginia  24279; Darlene Smith, whose last known address is P.O. Box 271, Pound, Virginia  24279; Christopher Smith aka William C. Smith, whose last known address is 313 3rd Avenue E, Big Stone Gap, Virginia  24219; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby 

     ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before September 22, 2025 in the Clerk’s Office of the Circuit Court of the County of Wise, Virginia, and do what may be necessary to protect their interests in this cause.
