Wise, VA 24293
WHEREAS, by Deed of Trust dated August 1, 2022, and recorded in the Clerk's Office of the Circuit Court of Wise, Virginia, by Instrument Number 202203552, Gavin Perry, unmarried man, conveyed to Diana Hill and Michael Page, Trustee, the hereinafter described real estate to secure the payment of a note in the original principal amount of $93,000.00.
WHEREAS, the undersigned was appointed and substituted as Substitute Trustee under this Deed of Trust by a substitution dated March 5, 2024, and recorded in the Office of the Register of Deeds for Wise, Virginia by instrument # 2024009263.
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Eastman Credit Union, the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Substitute Trustee has been directed to foreclose the Deed of Trust in accordance with the terms thereof; and
WHEREAS, the public is hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand, at the main entrance of Wise County Courthouse, 206 East Main Street, Wise, Virginia, at 10:00 a.m. on May 14, 2024.
All that certain tract, piece or parcel of land, together with improvements situate thereon and appurtenances hereto appertaining, located in the Birchfield Section, in the Gladeville Magisterial District of Wise County, Virginia, and being more particularly bounded and described as follow, to-wit:
TAX ID NO. 038616: BEGINNING on an iron pin in a line of James Kitelinger, corner to Randy Hale; thence leaving said Kitelinger and with said Hale S 17 11 54 E. 119.86 feet to an iron pin in a line of Mary Russell; thence leaving said Hale and with said Russell S 72 11 00 W 115.38 feet to an iron pin, corner to land now or formerly belonging to Noah Hall; thence leaving said Russell and with said Hall N 17 22 00 W 121.34 feet to an iron pin, corner to Scott Mullins; thence leaving said Hall and with said Mullins N 72 47 42 E 55.99 feet to an iron pin, corner to said Kitelinger; thence leaving Mullins and with said Kitelinger N 73 01 48 E 59.73 feet to the Beginning, containing 0.320 acre, as depicted on the attached plat of survey by Cornerstone Surveying dated August 20, 2002, incorporated herein by reference.
There is further CONVEYED a 10-food right of way across the remaining property of Scott M. Mullins and Chasity A. Mullins as depicted on the attached plat for ingress and egress to Bates Airfield Road and any other legal purpose such as utilities.
AND BEING the same property conveyed to Brandon Gilliam by Deed dated March 14, 2022 from Virginia Sue Mullins, of record in the Circuit Court Clerk's Office for Wise County, Virginia in Instrument No. 202201157, to which reference is hereby expressly made.
The above description was taken from a prior deed of record, no boundary line survey having been made at the time of this conveyance. The draftsman of this instrument assumes no liability as to the accuracy or content thereof.
