Red River Coal Company, Inc. is applying for bond reduction on Permit No.1101401 located in Wise County, North Fox Gap surface mine is located in Wise County approximately 6.5 miles southwest of Pound. The proposed permit area is north of Fox Gap on South Fork Pound River off State Route 620 and is on the Flat Gap, VA-KY USGS 7.5 minute quadrangle map. This permit consists of 575.91 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond) for $169,900.00 in the form of insurance surety. As provided by 4VAC25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting a Phase III bond reduction of $169,900.00 on increment number(s) 1 and 2 consisting of 570.28 and deleting 5.63 acres which is undisturbed and unbonded.

This bond reduction request is based on completion of backfilling & regrading on Increment 1 and 2 of 570.28 acres completed in 2015 - for Phase III bond release. The post-mining land use of unmanaged forest has been established through 6 growing seasons as confirmed by a vegetative study.

Any person with a valid legal interest which might be adversely affected by this proposal, or an officer or head of any federal, state or local government agency or authority, may within 30 days of July 19, 2022 submit written comments or objections concerning this bond reduction, and may also request, in writing, that the Division of Mined Land Reclamation hold an Informal Conference concerning this application. A copy of the application material is available electronically for public inspection at the Mined Land Reclamation's office in Big Stone Gap, Virginia.
