NOTICE OF SUBSTITUTE TRUSTEE'S SALE

In execution of that certain Deed of Trust dated March 26, 2007 and recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 200701244, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 202000300, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:

All of the following described lot or parcel of land, together with all improvements thereon and appurtenances thereunto belonging, situate in the Town of Appalachia, Wise County, Virginia, and more particularly described as follows:

“FOUR LOTS numbered Four (4), Five (5), Six (6) and Seven (7) in Block No. Nine (9) on a plat recorded in the office of the Circuit Court of Wise County, Virginia in Deed Book 32, page 37, etc., marked and known as 'Keystone Coal and Iron Company's Plat No. 2 of Appalachia, Virginia', which said four lots are together bounded and described as follows: Situate on the South Side of Walnut Street at the intersection of the South line of Walnut Street and with the West line of Park Avenue; continuing in front on Walnut Street 148 and fifty-seven one-hundredths (148.57) feet and extending at that width, at right angles to Walnut Street, between parallel lines, with the West line of Park Avenue, One Hundred Twenty-Five (125) feet to the North line of a twenty (20) feet wide alley, which divides said block.”

BEING the same property conveyed unto Jerry L. Rutherford, Sr. and Shirley J. Rutherford by deed dated December 15, 1992, from Charter Federal Savings Bank, which deed is of record in the Circuit Court Clerk's Office of Wise County, Virginia in Deed Book 743 at Page 396.

TIME OF SALE: 10:00 A. M.

TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
