In execution of that certain Credit Line Deed of Trust dated June 11, 2014 and recorded in the Circuit Court Clerk's Office of Wise County, Virginia in as Instrument Number 201402708, and by virtue of the authority vested in the undersigned Substitute Trustee, any one of whom may act, by said Deed of Trust, and the Deed of Appointment of Substitute Trustee recorded in the Circuit Court Clerk's Office of Wise County, Virginia as Instrument Number 201905333, default having been made in the terms of the Note secured by the Deed of Trust, and having been requested to do so by the Holder of the Note, the undersigned Substitute Trustee will offer for sale at public auction the following property as described in said Deed of Trust:

All that certain lot or parcel of land situate, lying and being in the Town of Big Stone Gap, Wise County, Virginia, and more particularly bounded and described as follows, to-wit:
Lot Thirty-six (36), as shown upon a certain plat of a part of the Town of Big Stone Gap, Wise County, Virginia, which said plat is marked and known as “Plat 4, Danberry Heights Subdivision, located in Big Stone Gap, Virginia, and showing Lots 1 through 45”, dated July 5, 1974, which said plat is of record, along with the certificate of dedication therefor, in the Clerk's Office of Wise County, Virginia, in Deed Book 471, Page 172, reference to which said plat is hereby specifically made for a further and fuller description of said lot or parcel of land.
This conveyance is made SUBJECT to all such exceptions, reservations, restrictions, covenants and conditions contained in that certain instrument referred to as “Danberry Heights Sub-Division Restrictions”, dated October 31, 1972, and of record in the Clerk's Office of Wise County, Virginia in Deed Book 448, Page 481, reference to which is hereby specifically made for a full and complete emmeration of said exceptions, reservation, restrictions, covenants and conditions.
There is EXCEPTED and RESERVED from the operation of this conveyance an easement for right-of-way in, under and over a certain strip of land fifteen (15) feet wide running along and parallel to the northern boundary line of the lot herein conveyed, said easement being for the purpose of installation, repair and maintenance of storm drainage, sewer, water, electric, telephone and other utilities.
PLACE OF SALE: Front Steps of the Wise County Courthouse; Main Street, Wise Virginia.
DATE OF SALE: Friday, January 17, 2020
TIME OF SALE: 11:00 A. M.
TERMS OF SALE: CASH. A deposit of 10% in cash or by check will be required of the successful bidder at the time of the sale and settlement in full shall be made within fifteen (15) days from date of sale at the office of said Substitute Trustee. The Substitute Trustee may change the terms of sale on the Date of Sale. The successful bidder will also be required to sign a Memorandum of a Foreclosure Sale.
This is an attempt to collect a debt and any information gathered will be used accordingly.
