IN EXECUTION of a Deed of Trust dated November 14, 2007, to Leonard D. Rogers, Trustee, securing Miners Exchange Bank the Noteholder in the original principal amount of $88,575.73, which said Deed of Trust is recorded as Instrument Number 200704851 in the Clerk's Office for Circuit Court of Wise County, Virginia, and Gregory D. Gilbert having been appointed as Substitute Trustee under document recorded as Instrument Number 201302865, and default having occurred thereunder, the Substitute Trustee at request of the Beneficiary, will offer for sale the following described property at public auction at the Eastern Front Door of the Wise County Courthouse, on Main Street, in the Town of Wise, Wise County, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]

All that certain property situate in the Flatwoods Section, in the Lipps Magisterial District of Wise County, Virginia, and further described as follows, to-wit:
BEGINNING at a brass-cap monument in the U.S. Government line; thence N 78˚ 55' E, 539.69 ft. to a fence corner at white oak sprouts, a comer to Maynard Greear; thence N 18˚ 00' W, 279.82 ft. to an iron pin, a comer to Edgar Greear; thence S 57˚ 54' W 709.11 ft. to an iron pin; thence N 55˚ 45' W, 300 ft. to an iron pin; thence N 1˚ 30' E 35 ft. to a brass-cap monument; thence N 34˚ 39' E 407.56 ft. back to the point of BEGINNING, and containing 7.07 acres, more or less, together with the 2007 Clayton Doublewide manufactured home situate on the above- described property. Tax ID No. 032058.
BEING the same property acquired under Deed dated March 7, 2003, recorded as Instrument No. 200301067, in the Wise County Circuit Court Clerk's Office, reference to which said Deed is hereby made.
There is EXCEPTED and RESERVED from the above conveyance that certain 3.096 acre parcel conveyed to Joan McClellan by Deed dated October 7, 1998, and recorded as Instrument Number 990002571.
There is also granted to the Grantees the use of any and all easements, rights of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
This Deed is made subject to any and all existing reservations, easements, exceptions, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above-described property.
There is also conveyed by this instrument all buildings, improvements, fixtures, appliances and/or easements, now or hereafter attached to or used in connection with the property herein described.

TERMS OF SALE: Cash or Cashier's Check. A non-refundable deposit of 10% of the sale price in cash or certified/cashier's check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, which must be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to the deed preparation and all fees to transfer the DMV Title. Sale is subject to such additional terms as Substitute Trustee may announce at the sale.
