JMAC Leasing, Inc., P.O. Box 900, Sandy Hook, Kentucky 41171, Application Number 1010678 is applying to the Virginia Division of Mined Land Reclamation for a permit to conduct coal surface mining and reclamation operations at the following location: At coordinates North 36.877359, West 82.832204, 1.0 miles East of Exeter on Laurel Fork of Pigeon Creek and Pigeon Creek of Powell River. The site is located on the Appalachia and Big Stone Gap quadrangles. The proposed operation will come within 100' measured horizontally, of the outside right of way line of Routes 68 / 606. The Application Map showing the proposed permit area is attached in Section 21.2 of the application.
Laurel Fork of Pigeon Creek and Pigeon Creek will receive drainage from the permit area. Laurel Fork and Pigeon Creek both ultimately flow into the Powell River. All drainage will pass through DMLR approved sediment control structures prior to leaving the permit. The locations of these structures can be found on the Surface Water Hydrology Map found in Section 21.2 of the application.
A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division's Big Stone Gap office. A copy of the application materials is available electronically for public inspection at https:/dmme.virginia.gov/DmlrPermits. Any person whose interests are or may be adversely affected by the proposed operation, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of December 24, 2019 submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed operation and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13(c) of the Virginia Coal Surface Mining Reclamation Regulations.
