IN EXECUTION of a Deed of Trust dated the 17th day of July, 2013, in principal amount of $125,362.53, recorded in the Clerk's Office of the Circuit Court for Wise County, Virginia, as Instrument Number 201302266, default having occurred thereunder, and having been requested to do so by the Beneficiary, the undersigned Substitute Trustee who was appointed under Instrument No. 201904383, will offer for sale at public auction at the Front Door of the Wise County Courthouse, 206 E. Main Street, in the Town of Wise, Virginia, [NOTICE: THIS SALE WILL NOT TAKE PLACE ON THE PREMISES OF THE PROPERTY BEING SOLD]
on the 19th day of
at 11:00 A.M.
the following described property situate, lying and being at Banner, in the Lipps Magisterial District of Wise County, Virginia, and being more particularly bounded and described as follows, to-wit:
BEGINNING at a stake in the western edge of the State Highway, in the Joe Martin line, and with said Martin line in a northwardly direction about 160 feet to a corner, thence westwardly with said Martin line about 200 feet to the C.H. Tickle line, and with his line, in a northern direction about 450 feet to an oak tree on the ridge, a corner to S. C. Kennedy, Jr., and with said Kennedy line in a northeastward direction about 325 feet to a stake on top of the ridge, and continuing with the S. C. Kennedy line in a northwestern direction about 175 feet to the Virginia Iron Coal and Coke Company line, near a break in the ridge, and with the said Company line in an eastwardly direction about 400 feet to a corner of the J.G. Hamm line; thence southward with the Hamm line about 325 feet to the top of the hill, thence continuing with the Hamm line to the Alford Robbins line, and with the Robbins line down the hill about 750 feet to a stake near an oak tree, a corner to the Robbins and Arnold Addington land, and with the Addington Land to the corner of a lot owned by said Geo. W. Kennedy and wife, with the line of said lot westward about 100 feet to a corner, and continuing with the line of said lot, southward about 225 feet to the State Highway, and with said Highway about 275 to the point of Beginning.
It is the intent to convey all of the interest of the Grantor in both Parcel ID 007424 and Parcel ID 007426 for the purposes of this conveyance whether included within the boundaries of the above referenced metes and bounds description.
There is also granted to the Grantees the use of any and all easements, right of ways, roadways, water rights, pipeline rights, sewer systems, including field lines attached thereto, in existence and which lawfully may be used by Grantors, whether by express grant, prescriptive use or otherwise, and which are appurtenant to and part of the use and enjoyment of this particular tract of land.
There is also conveyed by this instrument all buildings, improvements, fixtures, easements and appliances now or hereafter attached to or used in connection with the property herein attached.
This conveyance is made subject to all prior recorded conditions, restrictions, reservations, easements and conveyances affecting the property herein conveyed.

TERMS OF SALE: Cash. A deposit of 10% of the sale price in cash or certified check may be required at the time and place of sale with the balance of the sale price to be paid at settlement, to be held within THIRTY (30) days from the date of the sale; should purchaser fail to complete purchase within 30 days, the deposit is forfeited and the sale subject to termination or a charge of daily per diem interest thereon until closing date at option of Lienholder. The property and any improvements thereon shall be sold in "AS IS, WHERE IS" condition without any warranties. Title shall be transferred by Special Warranty Deed, and Buyer shall be responsible for all costs of conveyance including but not limited to deed preparation and all fees to transfer title. Sale is subject to such additional terms as Trustee may announce at the sale.
This is an attempt to collect a debt and any information obtained will be used for that purpose.
