In execution of a deed of trust signed by Rick Arrington, dated June 17, 2008, and recorded in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia in Deed Book 454, page 423, granting and conveying to C. The sale is subject to conditions, covenants, restrictions, reservations, party wall rights, easements, rights of way and other matters of record applicable to the property, and the real estate taxes from the date of sale.

TERMS OF SALE: All Cash

A deposit of 10% of the sales price by the bank’s cashier’s check payable to the Trustee may be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and the expenses of sale and the Trustee’s compensation authorized by the Deed of Trust and the law in such cases.

All costs of conveyance, which shall be by Special Warranty Deed, examination of title, recording fees, notary fees, settlement fees and Grantor’s tax, to be at the cost of the purchaser.

This permit consists of 263.33 acres with a current total bond amount of $1,365,000 in the form of (Insurance Surety). As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting a bond reduction of $180,600.00 on increment number(s) 2 and 3, consisting of 60.33 acres.

This bond reduction request is based on following Phase I reclamation

Post-mine land use will be Unmanaged Forestry/ Unde-veloped Land and Fish and Wildlife Habitat.

U. S. OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT (OSMRE)

BIG STONE GAP, VIRGINIA

OSMRE, in collaboration with each state to the extent possible, develops a state-specific Performance Agreement/Evaluation Plan tailored to the unique conditions of each state program.  Performance Agreements/ Evaluation Plans between OSMRE and the states establish how oversight is conducted during each evaluation year.  OSMRE’s Knox-ville Field Office will soon begin drafting the annual Performance Agreement/ Evaluation Plan with Virginia for OSMRE’s Evaluation Year 2015 that begins on July 1, 2014.  As a part of that process, we welcome input from interested parties to comment on oversight and provide suggestions for potential oversight evaluation topics, including the opportunity for discussion with our office.  For us to consider your comments and suggestions, we must receive them by March 30, 2014.
