Box 190 Appalachia, VA 24616 is applying to the Virginia Division of Mined Land Reclamation for Phase III bond release on Permit No.1301942 located in Wise County approximately 4.1 Miles NE of Dunbar on Pine Branch Creek. The post mining land use for this permit area is unmanaged forest. The northing and easting are 3555323.323 and 10248783.841, respectively. The permit area consists of approximately 10.88 Pool Bonded acres. The Flat Gap, Virginia USGS 7.5-minute topographic map was used to describe the location of the permit area.

As provided by § 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $40,000.00 in the form of a Certificate of Deposit posted for this permit be reduced by $40,000.00. This bond release request on this re-mining permit is based upon the completion of three growing seasons for this permit area of 10.88 acres.

The Banner Company is applying for bond reduction on Permit No.1201775 located in Dickenson County just north of West Dante on Austin Gap. This permit consists of 3.5 acres. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $40,000.00 in the form of insurance surety posted for this permit be reduced by $24,000.00.

This bond reduction request is based on the following Phase I reclamation:

Backfilling and regrading, topsoil placement, and seeding.

Reclamation was completed in December 2011.

All disturbed areas have been stabilized. Ground cover and trees are established where applicable.

The approved post mining land use for this permit is unmanaged forest/undeveloped land.

The Banner Company of 110 Sprint Drive, Blountville, TN 37617 is applying to the Virginia Division of Mined land Reclamation for a Renewal of PERMIT No. 1201487, in order to continue the operations at the following location.

The Site is located in Wise and Russell Counties approximately 3 miles north of Saint Paul on Honey branch. The site can be located on the Saint Paul, VA U.S.G.S. 7.5 Minute Quadrangle Map at a Latitude 36˚55’21” of and a Longitude of 82˚18’31.

The proposed operation comes within 100 feet of State route 628.

Drainage and waste water resulting from the permitted operation will be discharged from outfalls M-001 and M-002 into Honey Branch

A copy of the application materials is available for public inspection and comment at the Russell County Administrator Office and the Wise County Courthouse. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. This permit consists of 79.27 acres of which 66.85 acres have been disturbed. As provided by 4 VAC 25-130-800.40 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the current total bond amount of $240,000.00 (for the entire permit area) in the form of insurance surety posted for this permit by reduced by $144,000.00.

This bond reduction request is based on completion of the following reclamation:

1. Backfilling and regrading, topsoil placement, vegetation and tree planting.

2. Reclamation completed and approved 5-30-13.

3. All areas have been stabilized and drainage control established.
