TERMS OF SALE: CASH: A deposit of $5,000.00, or 10% of the sales price, whichever is lower, cash or certified check, will be required at the time of sale with settlement within fifteen (15) days from the date of sale. SUBSTITUTE TRUSTEE'S SALE OF VALUABLE

REAL ESTATE SITUATE

In execution of a Deed of Trust dated December 10, 2009, and recorded in the Office of the Clerk of the Circuit Court of Dickenson County, Virginia in Deed Book 473, Page 161, and with the undersigned being appointed Substitute Trustee by document of record in Deed Book 500, Page 715, the undersigned Substitute Trustee will offer for sale at public auction all that certain property, together with all improvements thereon and appurtenances thereunto belonging, more particularly described in the said Deed of Trust, having a street address of 5387 Bartlick Road, Haysi, Virginia; a tax map number of 179D-1170CC, and briefly described as follows:

Terms of Sale:  The Successful Bidder shall make a ten percent (10%) deposit at the time of sale, subject to the exception that the Trustee reserves the right to modify or waive the deposit requirement if the Noteholder is the successful bidder.  The entire amount of the successful bid must be paid in full by certified or bank cashier’s check within thirty (30) days after sale, and Time is of the Essence as to the closing date and payment of the purchase price.  The Property will be sold “AS IS, WHERE IS” and title will be conveyed by Special Warranty Deed.  Risk of loss will pass at the time of sale, and neither the Trustee nor the Noteholder will deliver possession of the Property to the successful bidder.  The purchaser of the Property will be required to pay all closing costs except the Grantor’s Tax, and real estate taxes will be pro-rated as of the original date of sale.  The purchaser of said premises will at the time and place of sale, sign a memorandum of purchase and an agreement to comply with the terms and conditions of the sale herein contained.  The Bidding will be kept open after the property is struck down; and in case any purchaser shall fail to comply with any of the above conditions of sale, the property so struck down will be again put up for sale under these same terms of sale, and the original purchaser will be held liable for any deficiency there may be between the sum for which the property may be purchased on the resale, and also for any costs or expenses incurred on such resale.  If for any reason the Substitute Trustee fails to convey title to the Property to the purchaser, the purchaser's sole remedy is the return of the Deposit paid by the purchaser on the date of the foreclosure sale.

A & G Coal Corporation is applying for bond release on Permit No. 1101822 located 4 miles SE of Pound on Powers Branch, Dickenson County, Virginia on the Caney Ridge and Pound USGS quadrangles, at coordinates N 3590330 and E 10313527. The application number is 1008943. This permit consists of 138.72 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond). As provided by 4 VAC 25-130-801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the total bond amount of $ 258,600 in the form of insurance surety currently posted for this permit be released.

This bond release request is based on completion of the extended period of responsibility (5 full years) for successful revegetation and the following reclamation: Successful revegetation of all areas, with seeding and tree planting occurring until 2004. The postmining land use of Agricultural, Grazing Land, has been achieved. Results of the reclamation are very good.

Any person with a valid legal interest which might be adversely affected by this proposal; or an officer or head of any federal, state or local government agency or authority may within 30 days of November 20, 2013 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for renewal of the referenced permit in order to continue operations at the following location:

Deep Mine No. 26 is located in Dickenson County off Route 703 approximately 1.1 miles WSW of Darwin, Virginia on Lick Fork. The permit area covers 64.71 acres and is located on the Pound, Virginia USGS quadrangle map at approximately 36E 58' 30" latitude, -82E 29' 50" longitude.

Drainage and wastewater resulting from the operation will be discharged as follows:

1. Receiving stream(s): Lick Fork

2. Type of discharge: Sedimentation ponds and mine discharge

3. All discharges are existing and are located within the mine site as described above

A copy of the renewal application is available for inspection and public comment at the Dickenson County Building Inspector’s office in Clintwood, Virginia. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office.
