In execution of a Credit Line Deed of Trust dated July 29, 2008, of record in the Circuit Court Clerk’s Office for Dickenson County, Virginia in Deed Book 456, Page 141, the undersigned Substitute Trustee (hereinafter “Trustee”) will, on Monday, September 16, 2013, at 11:30 a.m., at the front doors of the Dickenson County Courthouse, Main Street, Clintwood, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:

AND BEING the same property conveyed to Radford Mullins from Radford A. Mullins and Rita Mullins by Deed dated February 5, 2001, of record in the Circuit Court Clerk’s Office for Dickenson County, Virginia, in Deed Book 362, at Page 006.

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.

Bids may be solicited in parcels or in bulk, in the Substitute Trustee’s discretion. Deposit of $3,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder, or a deposit of 10% of the sale price, whichever is lower. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after the sale. The Trustee reserves the right to extend the date of settlement as may be necessary to complete arrangements for settlement. The Trustee also reserves the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Trustee may determine in her discretion.

The balance of the purchase price shall be in cash or its equivalent. The property and any improvements thereon shall be sold in “AS IS, WHERE IS” condition without any warranties. The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or owners or other parties in possession and their agents and not within the control of the Trustee, the Noteholder, or their successors or assigns. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale. Written notice has been sent to the owner(s) pursuant to Virginia law.

All that certain tract or parcel of land, with all the appurtenances thereto belonging, situate, lying and being on Hill Ridge, in Dickenson County, Virginia, and being more particularly bounded and described as follows:

Dickenson-Russell Coal Company, LLC., of 5703 Crutchfield Drive, Norton, Virginia, 24273 is applying to the Division of Mined land Reclamation for a NPDES Renewal of Permit 1401835 / 0081835 in order to continue operations. The permit is located at the following location:

The proposed mining area is located in Dickenson County 1.5 miles Northwest of Bucu on Fryingpan Creek. The existing permit area will cover approximately 44.58 acres in Dickenson County. The Permit is situated primarily in the watershed of Fryingpan Creek, and Big Spruce Pine Branch. The proposed mine is located on the Duty U.S.G.S. 7.5 minute quadrangle maps. The general coordinates of the permit are at latitude 37∞ 05’ 05” and longitude 82∞ 13’ 42”. All surface drainage will pass through approved sediment control structures and then be discharged into Fryingpan Creek.

A copy of the application materials is available for public inspection and comment at the Division of Mined Land Reclamation’s Office in Big Stone Gap, Virginia. Any person whose interests are or may be adversely affected by the proposed revision, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days after August 28, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the renewal application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.

Application for Bond Release

Under Chapter 19, Title 45.1

Code of Virginia

Publication Number 13HNM06

A & G Coal Corporation is applying for bond release on Permit No. 1101669 located in Clintwood, Dickenson County, Virginia on the Clintwood USGS quadrangle, at coordinates N 3604134.7966 and E 10325314.5740. The application number is 1008865. This permit consists of 178.22 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond). As provided by 4 VAC 25-130-801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the Applicant is requesting that the total bond amount of $ 417,000 in the form of insurance surety currently posted for this permit be released.

This bond release request is based on completion of the extended period of responsibility (5 full years) for successful revegetation and the following reclamation: Successful revegetation of all areas, with seeding and tree planting occurring until 2010. Postmining land uses of Agricultural, Grazing Land, Commercial, Public Use-Public Road, Residential, Unmanaged Forest, Fish and Wildlife Habitat, Species Managed Area, and Industrial have been achieved. Results of the reclamation are very good.

Any person with a valid legal interest which might be adversely affected by this proposal; or an officer or head of any federal, state or local government agency or authority may within 30 days of September 18, 2013 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation’s office in Big Stone Gap, Virginia.
