The existing pond and NPDES outfall 002 is at latitude 37º 07’ 27” and longitude 82º 32’ 02.8” on the Pound 7.5’ USGS Quadrangle. Surface drainage from Pond No. 2 will enter Lick Fork. Pond 4 is located in Wise County 2.0 miles east of Pound on Meade Fork next to Route 83. The existing pond and NPDES outfall 004 is at latitude 37º 07’ 46.7” and longitude 82º 33’ 15.6” on the Jenkins East USGS Quadrangle. Surface drainage from Pond No. 4 will enter Meade Fork.

This revision application proposes that an additional 67.94 acres be added to the approved limits of underground mining (PMU). Recovery of additional Upper Banner seam reserves is proposed by conventional underground mining method at the following location:
The proposed underground amended PMU is located to the north and east of the current PMU area north of State Route 607 at the headwaters of Wolfpen Branch and south of Pound River in Dickenson County. Surface drainage will be passed through sediment control structures prior to being discharge into receiving streams. Surface drainage from the permit area will enter Cranes Nest River and Neel Branch.
A copy of the application materials will be available for inspection and public comment at the Dickenson County Building Inspector’s Office, Clintwood, Virginia. The additional mining area will be located in Dickenson County.

IN THE MATTER OF:
BUCU PORTALS PROJECT
TO WHOM IT MAY CONCERN:
The Department of Mines, Minerals, and Energy, Division of Mined Land Reclamation, of the Commonwealth of Virginia, pursuant to the authority granted in the Virginia Coal Surface Mining Control and Reclamation Act of 1979 (Chapter 19, Article 4, Section 45.1-260 et seq.,) with funding provided by the 2011 Consolidated Grant, has determined and found that:
Land located along State Route 600 (Frying Pan Creek) in Dickenson County, Virginia, has been adversely affected by past coal mining practices, to wit:
1. Property owners, both known and unknown, are hereby notified of the Division’s intention to reclaim the area adversely affected by past coal mining practices. The purpose of this Notice is to provide notice to any landowners, heirs, assigns and devisees who may be affected by the proposed reclamation and who have not been identified and who have not granted written consent.
2. The public health, safety and property is endangered by: open and accessible mine entries.
3. The proposed action consists of:
Permanently sealing open mine entries within the project area
Establishing vegetation on all areas affected by this work.
Utilizing drainage and sediment control throughout the duration of this project.
Existing gas well roads will be used to access some of these sites and temporary stream crossings and stream fords will be constructed. All temporary crossings will be eliminated when this project is complete.
4. Known property owner(s) in the area of the proposed reclamation are:

Based upon the above findings, the Commonwealth of Virginia, acting by and through the Department of Mines, Minerals and Energy, Division of Mined Land Reclamation, its agents, employees and contractors, gives notice that this Notice being published in The Dickenson Star, and posted on the property, the Division will initiate and continue until the proposed work on the Bucu Portals Project is complete, and shall do all things necessary and expedient to protect the public health, safety and general welfare. Such entry shall not be construed as an act of condemnation of property nor of trespass thereon.
