This proposed ordinance 1) defines prohibited acts declared to cause excessive noise, 2) establishes exceptions to be permitted, and 3) prescribes a fine of not less than $250 for the first offense and not more than $500 for the second or subsequent violations.
At the public hearing, citizens may appear and present their views. COURTHOUSE PARKING LOT
The Wise County Board of Supervisors is seeking proposals from contractors for the design and construction of a retaining wall for the parking lot expansion project to the rear of the Wise County Courthouse.
The project will involve construction of an adequate foundation, a reinforced concrete block wall of approximately 190 feet in length tied back to the existing rock cut slope, and with a stone veneer face and a top stone cap. The bidder shall be responsible for field verifying the required length and height of the wall, prior to submitting a proposal.
The successful contractor will be responsible for all excavation, grading, backfill, foundation design, drainage system, and obtaining all necessary permits that may be associated with this project.
The County requests the proposal specify cost break-downs for:
Construction of the foundation, erection of the reinforced retaining wall, and related cost items, and,
Stone veneer face and top stone cap.
The County reserves the right to accept or reject any and all proposals.

FY2013 ABANDONED MINE LAND CONSOLIDATED GRANT
The Virginia Department of Mines, Minerals and Energy’s (DMME) Division of Mined Land Reclamation (DMLR) is submitting a grant request to the U. S. Department of the Interior, Office of Surface Mining and Reclamation Enforcement (OSMRE) for funding of the Fiscal Year 2013 Abandoned Mine Land (AML) Consolidated Grant. The AML Consolidated Grant provides support for program administration and construction projects for Virginia’s AML Programs.
The AML Administration Program provides support for Virginia’s AML Program to protect the public health, safety and general welfare from the adverse effects of coal mining practices that occurred prior to the enactment of the Federal Surface Mining Control and Reclamation Act of 1977. The AML Construction Reclamation Program provides funding for the reclamation of abandoned mine sites that endanger public health, safety and general welfare and are the results of adverse impacts of past coal mining practices prior to the Federal Act. Subject to federal funding, the following projects will be pursued.
1. Special Set-Aside Project FY2013
Special set-aside monies will be used to study, design, construct and monitor acid mine drainage (AMD) remediation projects.
2. Engineering Project FY2013
Engineering provides for design work, realty and environmental permitting for AML reclamation projects.
3. Maintenance FY2013
Maintenance provides for repair work on previously completed projects.
4. Water Supply Projects FY2013
Projects to assist with public water system expansions in AML areas will be conducted.
5. Virginia Coalfield Projects FY2013
Virginia Coalfield Projects will be performed in accordance with Virginia’s Abandoned Mine Land Reclamation Plan, as amended, and in accordance with the provisions of P.L. 95-87, as amended, the Title IV Regulations, and the Federal Assistance Manual. The intent of reclamation will be to address Priority 1, 2, and 3 features within specific problem areas. Reclamation of Priority 3 features will be either an integral part of, or incidental to reclamation of Priority 1 and 2 features.
Agaze Shaft: Project is in Chesterfield County, near Midlothian. Reclamation will seal a vertical opening.
Charlie Hollow Landslide: Located adjacent to County Rd. 2295 off State Rt. 609 near Harman, Buchanan County. Reclamation will stabilize a landslide impacting the county road.
Dominion Road Drainage: Located at the end of Dominion Rd., 0.6 miles from the intersection of Dominion Rd. and Upper Mill Branch Rd. (Rt. 674) northeast of Grundy, Buchanan County. Reclamation will close mine openings and treat impacts of mine drainage.
Hamilton Drainage: Located at the headwaters of Yellow Creek on Blackstone Rd. off Hurricane Rd. near Wise, Wise County. Proper drainage control will be installed.
Haywood Lane: Site is located south of Haywood Lane off Merrimac Rd., Montgomery County and consists of several areas over a large tract of land west of Rt. 657. Reclamation will seal mine openings, fill voids, repair subsidence, stabilize coal waste piles, reestablish stream channels, control drainage and revegetate.
Midlothian Mines Park, Phase 2B: Project is in Chesterfield County, near Midlothian. Reclamation will grout subsidence features, remediate surface water erosion and close Grove Shaft.
Plaster Drainage: Located approximately 0.9 miles north of the intersection of State Rt. 72 and S.R. 652 in the Cranes Nest community, Wise County. Reclamation will install drainage control and revegetate.
South Fork Blowout II: Located along State Rt. 620, approximately 0.1 mile south of the intersection of Dewey Rd. (Rt. 627), Wise County. A potentially dangerous impoundment will be abated by dewatering the mine pool, excavating and disposing of unstable material, installing a wet mine seal and stabilizing the site.
South Fork Clogged Stream: Located along State Rt. 620, approximately 0.1 mile southeast of the intersection of Dewey Rd. (Rt. 627), Wise County. Project will remove and dispose of sediment from an unnamed tributary to the South Fork Pound River.
Stanley Subsidence: Located along Bowser Rd., approximately 1.2 miles northwest of the intersection of Bold Camp Rd. and Birchfield Rd., Routes 633 and 634, Wise County. Reclamation will stabilize a subsidence area.
White Chimney Shaft: Project is in Chesterfield County, near Midlothian and will seal a vertical opening.
Whiteoak Road Impoundment: Located off Rt.706, approximately 3.8 miles southeast of Wise. Reclamation will include removal of an impoundment.
Yeary Drainage: Located in the Town of Wise, approximately 0.4 mile northeast of the intersection of Hurricane Rd. and Darden Drive, Routes 640 and 646, Wise County. Reclamation will install drainage control.
AML Enhancement Projects: Projects wherein a contractor can remove and sell incidental coal and use the revenue to offset the cost of AML reclamation will be considered throughout the Virginia coalfields. DMLR will accomplish these projects as government financed construction exemption projects.
No-Cost Highwall Elimination Projects: Highwalls and other AML features will be eliminated using excess spoil from active mining operations. Projects will be accomplished at no cost to the Virginia AML program in cooperation with active mining operations (in accordance with 4 VAC 25-130-816.76 of the Virginia Coal Surface Mining Reclamation Regulations).
Tree Planting Projects: Trees will be planted on AML sites throughout the southwest Virginia coalfields. Trees will also be planted on AML Enhancement Projects as a component of government financing of enhancement projects.

The Department of Mines, Minerals, and Energy, Division of Mined Land Reclamation, of the Commonwealth of Virginia, pursuant to the authority granted in the Virginia Coal Surface Mining Control and Reclamation Act of 1979 (Chapter 19, Article 4, Section 45.1-260 et seq.,) with funding provided by the 2011 Consolidated Grant, has determined and found that:
Land located off State Route 603 approximately 1.4 miles southeast of the community of Dunbar in Wise County, Virginia, has been adversely affected by past coal mining practices, to wit:
1. Property owners, both known and unknown, are hereby notified of the Division’s intention to reclaim the area adversely affected by past coal mining practices. The purpose of this Notice is to provide notice to any landowners, heirs, assigns and devisees who may be affected by the proposed reclamation and who have not been identified and who have not granted written consent.
2. The public health, safety and property is endangered by: a landslide that is the result of mine spoil that was pushed over the hillside during mining operations that occurred before 1977. This landslide could block Roaring Fork as well as State Route 603.
3. The proposed action consists of:
Improving existing access roads and/or construction of new access roads as needed
Removing the landslide to natural ground or regrading the site to a stable configuration. All of the excavated material will be hauled to an active, permitted mine site where the material will be incorporated into the approved reclamation of the active surface mine.
Establishing positive surface drainage as needed.
Revegetating all areas disturbed by this work
Standard erosion and sediment control measures will be utilized for the duration of this project
4. Known property owner(s) in the area of the proposed reclamation are:
