Red River Coal Company, Inc., P.O. Box 668, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for renewal of CSMO Permit Number 1100044/NPDES Permit Number 0080044 in order to continue the operations at the following location:

One mile north of Dixiana east of Route 620 in Wise County. The permit area is on the southern slope of Indian Mountain and extends from Route 620 east to Steve Horn Branch

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

The proposed operation will come within 100 feet of State Route 620.

Drainage and wastewater resulting from the permitted operation will pass through approved sediment control structures and be discharged to Guest River and Steve Horn Branch.

A copy of the application materials is available for public inspection and comment at the Wise County Circuit Court Clerk’s Office. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the Renewal application, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of November 20, 2012 submit written comments or objections to the Division of Mined Land Reclamation concerning the renewal application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.

IN THE MATTER OF:

SHORTT TOWN ROAD DRAINAGE PROJECT

TO WHOM IT MAY CONCERN:

The Department of Mines, Minerals, and Energy, Division of Mined Land Reclamation, of the Commonwealth of Virginia, pursuant to the authority granted in the Virginia Coal Surface Mining Control and Reclamation Act of 1979 (Chapter 19, Article 4, Section 45.1-260 et seq.,) with funding provided by the 2010 Consolidated Grant, has determined and found that:

Land located on Shortt Town Road on the west side of Rt. 632 (Right Fork Road) in Wise County, Virginia, has been adversely affected by past coal mining practices, to wit:

1. Property owners, both known and unknown, are hereby notified of the Division’s intention to reclaim the area adversely affected by past coal mining practices. The purpose of this Notice is to provide notice to any landowners, heirs, assigns and devisees who may be affected by the proposed reclamation and who have not been identified and who have not granted written consent.

2. The public health, safety and property is endangered by: drainage from an abandoned surface mine.

3. The proposed action consists of:

Construction and installation of drainage structures to capture and convey mine drainage to Mullins Fork.

Regrading and resurfacing affected areas of Shortt Town Road.

Revegetating all areas disturbed by this work.

Utilizing standard erosion and sediment control measures for the duration of this project

Traffic on Shortt Town Road will be interrupted periodically.

4. Known property owners in the area of the proposed reclamation are:

Based upon the above findings, the Commonwealth of Virginia, acting by and through the Department of Mines, Minerals and Energy, Division of Mined Land Reclamation, its agents, employees and contractors, gives notice that this Notice being published in The Coalfield Progress, and posted on the property, the Division will initiate and continue until the proposed work on the Shortt Town Road Drainage Project is complete, and shall do all things necessary and expedient to protect the public health, safety and general welfare. Such entry shall not be construed as an act of condemnation of property nor of trespass thereon.

The permit area can be reached by turning west off Rt. 620 approximately 1.2 miles north of the intersection of Rt. 620 and 701. The permit area covers 1,254.37 acres on the eastern slope of Indian Mountain between Fox Gap and Powell River.

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

The proposed operation will come within 100 feet of State Routes 626 and 825.

Drainage and wastewater resulting from the permitted operation will pass through approved sediment control structures and be discharged to Guest River, Critical Fork, Powell River, Phillips Creek, and South Fork Pound River.

Notice is hereby given that the Coeburn Town Council will conduct a Public Hearing on Monday, November 26, 2012 at 6:30 p.m. in Council Chambers at 502 Front Street E to solicit public input on a proposed charter revision that would reverse the revision enacted by the General Assembly July 1, 2012, restoring the positions of Treasurer and Chief of Police to the list of officers appointed by Town Council.

A copy of the proposed revision is available for review at the Coeburn Town Hall between 8:00 a.m. and 4:30 p.m. Monday through Friday.
