FORECLOSURE SALE

TRUSTEE’S SALE OF PROPERTY LOCATED in Gray Bottom on Guest River, Wise County, Virginia, and more particularly described as follows:

All those three (3) certain lots, pieces or parcels of land situate, lying and being in the Gray Bottom on Guest River, Wise County, Virginia, described as follows:

BEING Lots number Twenty-two (22), Twenty-three (23), and Twenty-four (24), on Map No. 1, of the Norton Realty Company, Inc., prepared by Scarborough and Dotson Engineers, dated December 11, 1922, which said three lots join each other and front 250 feet on Park Avenue, 150 feet on Riverview Street, and 190 feet on an alley, and a 15 feet wide alley on the bank of Guest River, as shown by the map aforesaid on said Subdivision, to which map reference is hereby made for a more particular description of said lots.

And being the same parcel conveyed to Virginia Collins Crawford (a/k/a Virginia Crawford Hawk) by deed dated October 20, 1966, of record in the Wise County Circuit Court Clerk’s Office in Deed Book 399, at Page 379, by deed dated July 30, 1981, of record in Deed Book 566, at page 662, and to Julia Ann Crawford by deed dated TILLER AND TILLER, P.C.arch 19, 1973, of record in Deed Book 467, at Page 565.

Immediately following sale of real property there shall be a public auction of personal property which is described as a 1988 Lakefront Double Wide Mobile Home, VIN #CLR2903A and CLR2903B.

In execution of Deed of Trust from Virginia Crawford Hawk and Julia Ann Crawford, dated September 22, 2004, recorded as Instrument No. 200404793, and by Modification Agreement dated June 3, 2007, of record in the aforesaid Clerk’s Office as Instrument No. 200702329, the undersigned Trustee will offer for sale at public auction at the Courthouse door in Wise, Wise County, Virginia, on the 10th day of October, 2012, at 11:00 a.m., the above described property. Reference is made to said Deed of Trust for a more particular description of said property.

TERMS: Cash, minimum of 10% bid amount will be required to be paid at the time and place of sale, balance within 30 days or upon delivery of deed. Title will be conveyed by Special Warranty Deed upon payment of the balance of bid. COAL SURFACE MINING/NPDES PERMIT

UNDER CHAPTER 19

PUBLICATION NUMBER

Red River Coal Company, Inc. of P.O. Box 668, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation for renewal of CSMO Permit Number 1100024/NPDES Permit Number 0080024 in order to continue the operations at the following location:

Off State Routes 626 and 825 near Lipps, in Wise County, Virginia, along the ridge between Big Branch and Pinnacle Creek; and in Hall Branch approximately one-half mile east of Route 620.

The permit area is located on the Flat Gap, VA-KY USGS quadrangle map.

Drainage and wastewater resulting from the permitted operation will pass through approved sediment control structures and be discharged to Big Branch, Hall Branch and Guest River.

A copy of the application materials is available for public inspection and comment at the Wise County Circuit Court Clerk’s Office. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the Renewal application, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of October 9, 2012 submit written comments or objections to the Division of Mined Land Reclamation concerning the renewal application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.
