Being that same property devised and bequeathed to Dewey Beldon Fields, Jr., and Paul Ed Fields by the Last Will and Testament of Dewey Fields, who died July 23, 1974, in Dickenson County, Virginia.
EXCEPTING and RESERVING from this conveyance all coal, gas, oil, minerals and mineral/mining rights as may have been heretofore sold or conveyed.
This conveyance made SUBJECT to any and all reservations, easements, exceptions, conditions, restrictions and/or adverse conveyances as the same may lawfully affect the above-described property.

In execution of a Credit Line Deed of Trust dated October 7, 2006, of record in the Circuit Court Clerk’s Office for Dickenson County, Virginia in Deed Book 430, Page 749 (which Deed of Trust was corrected by Corrected Credit Line Deed of Trust dated October 7, 2006, of record in the aforesaid Clerk’s Office in Deed Book 448, Page 114), the undersigned Substitute Trustee (hereinafter “Trustee”) will, on Monday, July 23, 2012, at 1:00 p.m., at the front doors of the Dickenson County Courthouse, Main Street, Clintwood, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.
Bids may be solicited in parcels or in bulk, in the Substitute Trustee’s discretion. Deposit of $3,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder, or a deposit of 10% of the sale price, whichever is lower. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after the sale. The Trustee reserves the right to extend the date of settlement as may be necessary to complete arrangements for settlement. The Trustee also reserves the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Trustee may determine in her discretion.

The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or owners or other parties in possession and their agents and not within the control of the Trustee, the Noteholder, or their successors or assigns. Application for Bond Release
Under Chapter 19, Title 45.1

Paramont Coal Company Virginia, LLC is applying for bond release on Permit # 1101895 located in Wise and Dickenson Counties, 5 miles west of Clintwood, VA off Route 631 on Cane Branch. This permit consists of 29.11 acres which are bonded under the Virginia Coal Surface Mining Reclamation Fund (Pool Bond). As provided by 4VAC25-130.801.17 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting that the total bond amount of $10,000 in the form of an insurance surety currently posted for this permit be released.
This bond release request is based on completion of the extended period of responsibility (6 full years) for successful revegetation and the following reclamation:
1. Backfilling, regrading and revegetation of all disturbances.
2. Hydroseeding was performed in 04/05 and trees planted in 02/06.
3. The post-mining land uses on this permit are unmanaged forest and fish & wildlife habitat.
Any person with a valid legal interest which might be adversely affected by this proposal; or an officer or head of any federal, state or local government agency or authority may within 30 days of August 8, 2012 submit written comments or objections concerning this bond release, and may also request, in writing, that the Division of Mined Land Reclamation hold a public hearing or an informal conference. A copy of materials concerning this request will be available for public inspection at the Division of Mined Land Reclamation's office in Big Stone Gap, Virginia.

Dickenson County Behavioral Health Services will destroy inactive consumer records beginning July 31, 2012, according to the code of Virginia Section 42.1-79. The consumer or an authorized representative will have an opportunity to request possession of their record by calling our office. Proof of identity will be required. Included in the purging will be adult records inactive prior to December 30, 2005. Included will be inactive records of juveniles who are 18 years of age, with a minimum retention of 6 years. Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, Va. 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a Revision of Permit No. 1201856. This revision application proposes that an additional 533.15 acres be added to the approved limits of underground mining (PMU). Recovery of additional Lower Banner seam reserves is proposed by conventional underground mining method at the following location:
The proposed underground amended PMU is located to the north and east of the current PMU area south of State Route 83 at the headwaters of Georges Fork in Dickenson County.
A copy of the application materials will be available for inspection and public comment at the Dickenson County Building Inspector’s Office, Clintwood, Virginia. The additional mining area will be located in Dickenson County.
Any person whose interests are or may be adversely affected by the proposed operation, or any officer or head of any Federal, State, or Local Government agency or authority may within 30 days of July 18, 2012 submit written comments or objections, concerning the proposed operation, and may also request in writing, that VDMLR hold an informal conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13(c) of VDMLR’S Regulations.
