This suit is petition for direction concerning the determination of beneficiaries of the Estates of Dolphus Kiser and Dora Kiser and the proper distributions to same.
An affidavit having been made that the whereabouts and post office address of Vicky Ann Owens, Mary Beth Owens, Donna Owens, Beau Perry, and Jonathan Weiant are unknown; that Melanie Wendell, Kimberly Wendell, Karol Wendell, Pam Cavanaugh, David B. Mullins, Toni McBroom, Robert Howard Davis, Dana Lee Davis, Jr, Elizabeth Davis, Christopher Davis, Berkeley Trent Krams, Penny George, Jack Hopkins, Harriet Ann Mullins, Thelma Kay Kiser, Elizabeth K. Brandon are non-residents of the Commonwealth of Virginia, and that their last known addresses are as indicated above; and that there may be other unknown heirs, devisees, and successors in interest of Dolphus Kiser and Dora Kiser and other deceased persons who are listed above, who may have an interest in the Estates of Dolphus Kiser and Dora Kiser, and that their names, whereabouts, and addresses, if any, any unknown, it is hereby ordered that such persons appear on or before the 16th day of November, 2012, and take such steps as may be necessary to protect their interests in this suit.
And, it is further ORDERED that this order be published once a week for four successive weeks in The Dickenson Star, a newspaper of general circulation in the County of Dickenson; and that a copy of this order be posted at the front door of the Courthouse wherein this Court is held.

OF SURFACE MINING BLASTING SCHEDULE
In compliance with Section 4 VAC 25-130-816.64 of the Virginia Coal Surface Mining Reclamation Regulations, notice is hereby given that Paramont Coal Company Virginia, LLC, having been issued Surface Mine Permit No. 1101998, will be conducting blasting operations on the permit area. The permit area is located approximately 2.8 miles west of Dante off State Routes 650, 652 and 746 in Dickenson County. Blasting will be in accordance with all applicable State and Federal laws and will commence according to the following schedule of dates and times, as approved by the regulatory authority:

Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal, indicated by three long blasts on an air horn, will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two minute delay, then one long horn blast prior to the blasting and an all-clear signal indicted by three short blasts will be audible within a range of one-half mile from the point of the blast in accordance with applicable State and Federal laws.
Also, blasting will not be conducted at times other than those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the regulatory authority.
Anyone owning a dwelling or structure located within one-half mile of the permit boundary desiring to have a pre-blast survey conducted may notify the Division of Mined Land Reclamation, P.O. Drawer 900, Big Stone Gap, VA 24219, phone (276) 523-8190. The request must be made in writing and should include a daytime telephone number.

Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, VA 24273, is applying to the Virginia Division of Mined Land Reclamation for a CSMO/NPDES permit renewal (1601896/0081896) for the Hughes Branch Mine.
The permit site is located approximately 1.3 miles northeast of Clinchco on McClure River. The permit is located on the Haysi USGS 7.5 minute quadrangle map at latitude 37° 10’ 20” and longitude 82° 20’ 27.”
Drainage from existing NPDES outfalls associated with the permitted operation will be discharged into Hughes Branch and McClure River.
A copy of the application materials is available for public inspection and comment at the Dickenson County Building Inspector Office in Clintwood, VA. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed operation, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of (October 17, 2012) submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed operation (and may also request, in writing, that the Division hold an Informal Conference concerning the application. The Spraddle Branch Deep Mine is located in Dickenson County, approximately 1.2 miles west of McClure, off State Route 773, on Caney Creek. The permit area is approximately 9.21 acres with a State Plane Northing of 3,582,730 and State Plane Easting of 10,346,293 on the Caney Ridge, Virginia USGS 7.5 minute topographic quadrangle. Drainage and wastewater resulting from the operations will pass through approved sediment control structures prior to being discharged into Caney Creek of the Russell Fork River.

Paramont Coal Company Virginia, LLC, 5703 Crutchfield Dr, Norton, Virginia 24273 is applying to the Virginia Division of Mined Land Reclamation (VDMLR) for a permit to conduct coal mining and reclamation operations at its Deep Mine #44 at the following location:
The proposed site is located in Dickenson County approximately 3 miles southeast of McClure off State Route 674. The proposed permit area covers approximately 16.02 acres at north 3,568,136 and east 10,353,007 on the Caney Ridge and Nora 7.5’ USGS Quadrangle. The permit area is situated along Rush Branch a small tributary to Open Fork and McClure River. Access to the permit will be from State Route 674.
Surface drainage will pass through approved sediment control structures. Surface drainage will be discharged into Rush Branch.
A copy of the application materials will be available for inspection and public comment at the Dickenson County Building Inspector’s Office, Clintwood, Virginia. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at VDMLR’s Big Stone Gap office.
