In execution of a Credit Line Deed of Trust dated May 5, 2006, of record in the Circuit Court Clerk’s Office for Dickenson County, Virginia in Deed Book 425, Page 356 (Instrument No. 060000767), the undersigned Substitute Trustee (hereinafter “Trustee”) will, on Friday, October 26, 2012, at 1:00 p.m., at the front doors of the Dickenson County Courthouse, Main Street, Clintwood, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:
All that certain tract or parcel of land, with all the appurtenances thereto belonging, situate, lying and being on Hill Ridge, in Dickenson County, Virginia, and being more particularly bounded and described as follows:
BEGINNING at a stake on the east side of a small pond and a corner to Thomas Austin’s tract; thence S 86 01 W 357.6 feet to a stake, hickory and sassafras as witness, (sourwood called for); thence N 7 49 E 105.8 feet to a 12 inch leaning sassafras on a cliff, a corner to the Clemont Rose 1.15 acre tract; thence with line of same, N 85 55 E 314.6 feet to a corner in Thomas Austin’s tract; thence with a line of same, S 18 45 E 104.0 feet to the BEGINNING, containing 0.81 of an acre, more or less, and being the same land conveyed to Brian Keith Turner and Donna Deidra Turner by Ervin Large and Wanda Large by deed dated April 28, 2006, of record in Deed Book 425, page 353, of the Clerk’s Office of the Circuit Court of Dickenson County, Virginia.
There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.
Deposit of $2,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder, or a deposit of 10% of the sale price, whichever is lower. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after the sale. The Trustee reserves the right to extend the date of settlement as may be necessary to complete arrangements for settlement. The Trustee also reserves the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Trustee may determine in her discretion.
The balance of the purchase price shall be in cash or its equivalent. The property and any improvements thereon shall be sold in “AS IS, WHERE IS” condition without any warranties. The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or owners or other parties in possession and their agents and not within the control of the Trustee, the Noteholder, or their successors or assigns. The purchaser will be required to sign a Memorandum of Sale incorporating all the terms of the sale. Written notice has been sent to the owner(s) pursuant to Virginia law.

An affidavit having been made that the whereabouts and post office address of Vicky Ann Owens, Mary Beth Owens, Donna Owens, Beau Perry, and Jonathan Weiant are unknown; that Melanie Wendell, Kimberly Wendell, Karol Wendell, Pam Cavanaugh, David B. Mullins, Toni McBroom, Robert Howard Davis, Dana Lee Davis, Jr, Elizabeth Davis, Christopher Davis, Berkeley Trent Krams, Penny George, Jack Hopkins, Harriet Ann Mullins, Thelma Kay Kiser, Elizabeth K. Brandon are non-residents of the Commonwealth of Virginia, and that their last known addresses are as indicated above; and that there may be other unknown heirs, devisees, and successors in interest of Dolphus Kiser and Dora Kiser and other deceased persons who are listed above, who may have an interest in the Estates of Dolphus Kiser and Dora Kiser, and that their names, whereabouts, and addresses, if any, any unknown, it is hereby ordered that such persons appear on or before the 16th day of November, 2012, and take such steps as may be necessary to protect their interests in this suit.

Paramont Coal Company Virginia, LLC, 5703 Crutchfield Drive, Norton, VA 24273, is applying to the Virginia Division of Mined Land Reclamation for a CSMO/NPDES permit renewal (1601896/0081896) for the Hughes Branch Mine.
The permit site is located approximately 1.3 miles northeast of Clinchco on McClure River. The permit is located on the Haysi USGS 7.5 minute quadrangle map at latitude 37° 10’ 20” and longitude 82° 20’ 27.”
Drainage from existing NPDES outfalls associated with the permitted operation will be discharged into Hughes Branch and McClure River.
A copy of the application materials is available for public inspection and comment at the Dickenson County Building Inspector Office in Clintwood, VA. A copy of the draft NPDES permit and fact sheet are available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed operation, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of (October 17, 2012) submit written comments or objections to the Division of Mined Land Reclamation concerning the proposed operation (and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130.773.13(c) of the Virginia Coal Surface Mining Reclamation Regulations.
