In execution of a Credit Line Deed of Trust dated February 5, 2010, recorded as Instrument Number 201000465 in the Clerk’s Office for the Circuit Court of Wise County, Virginia, the undersigned Trustee (hereinafter “Trustee”) will, on Tuesday, September 17, 2013, at 11:00 a.m., at the front doors of the Wise County Courthouse, East Main Street, Wise, Virginia, offer for sale at public auction to the highest bidder the following property with improvements thereon:

All that certain tract, piece or parcel of land situate, lying and being in Wise County, Virginia, Lipps Magisterial District, on Sandy Ridge, and more particularly bounded and described as follows, to-wit:

BEGINNING at a stone five hundred twenty (520) feet from County Road, known as the Bull Hill Road, Highway No. 650, running N 82 W two (200) hundred feet to a stone in the original line of the Martha E. Carrico survey; thence with the line fence of the John H. Meade and W. A. Hillman boundary line being four hundred thirty-eight (438) feet to the edge of the Bull Hill Road, this being the corner agreed upon by W. A. Hillman and J. H. Meade by their exchange of tracts, thence with the said Bull Hill Road, two hundred feet S 41 E to a stone by the road; thence to the stone at the BEGINNING on the W. A. Hillman and the Orbin Meade boundary line, containing two (2) acres, more or less.

BEING the same property conveyed to Joseph W. Kiser and Rebecca F. Kiser by Deed dated July 28, 1990 and recorded in the Wise County Circuit Court Clerk’s Office in Deed Book 697, Page 446.

There is excepted and reserved from this conveyance such of the coal, oil, gas, minerals, rights, privileges, etc., that have been heretofore sold or excepted from said property. This property is made subject to and/or benefit of those additional superior liens, mechanics’ liens, restrictions, covenants, easements, rights of way, and conditions applicable to said real estate, if any there be, as contained in prior deeds properly of record.

Deposit of $3,000.00 cash or check drawn upon certified funds (no personal or cashier’s checks drawn upon uncertified funds accepted without prior Trustee approval) or 10% of the bid price, whichever is less, for the bid shall be required to qualify as a bidder before the sale, except from the Noteholder. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after the sale. The Trustee reserves the right to extend the date of settlement as may be necessary to complete arrangements for settlement. The Trustee also reserves the right to amend or supplement the terms of sale by verbal announcements during the sale, modify the requirements for bidders’ deposits, withdraw all or part of the property from the sale before the commencement of bidding, recess the sale, and conduct such other sales as the Trustee may determine in her discretion.

The balance of the purchase price shall be in cash or its equivalent. The property and any improvements thereon shall be sold in “AS IS, WHERE IS” condition without any warranties. The purchaser recognizes and agrees that any investigation, examination, or inspection of the Property is within the control of the owner or owners or other parties in possession and their agents and not within the control of the Trustee, the Noteholder, or their successors or assigns. NOTICE OF PUBLIC HEARING

The Wise County Public Service Authority will hold a Public Hearing at its office in Wise, Virginia on the 8th day of October, 2013 at 6:05 p.m., to receive public comments concerning proposed establishment of sewer rates, fees and charges for the sewer systems serving the Roda, Osaka, Stonega, Upper Exeter, Lower Exeter, Imboden and Derby Communities (“Appalachia Operations Area”).

The Wise County Public Service Authority has made the following proposed sewer rates, fees and charges:

The Authority will utilize the Town of Appalachia’s water rates as the basis for billing its customers for sanitary sewer service. Customers of the Appalachia Operations Area will be billed one hundred twenty-five percent (125%) of their monthly water bill, which equates to a rate of $25.06 for the first 1,000 gallons of water used, and $8.19 for each additional 1,000 gallons.

In the event the Town of Appalachia increases its rates for water service, the Authority’s sewer rate of one hundred twenty-five percent (125%) of the customer’s monthly water bill shall remain in full force and effect.

The Clinch Ranger District has received requests to hold two recreation events using the Pine Mountain Trail, and trails, roads and a forested area associated with the Pine Mountain Trail in Wise and Dickenson Counties.

Pursuant to 36 CFR 215, District Ranger Jorge Hersel is requesting comments on the proposed recreation events described below:

The Breakdown Event. 361 Adventures has requested the use of a combination of trails and roads along the Pine Mountain Trail west of the Breaks Interstate Park and an area north of Maynard Ridge, in Dickenson County for a two-day adventure race in April of 2014 that involves mountain biking and trekking on foot.

Cloudsplitter 100 Event. Moonbeam Dreams L.L.C. has requested to host a trail race using the Pine Mountain Trail on National Forest System Lands west of the Break Interstate Park in Dickenson and Wise Counties.

Any person whose interests are or may be adversely affected by the renewal application, or an officer, or head of any federal, state, or local government agency or authority may within 30 days of October 4, 2013 submit written comments or objections to the Division of Mined Land Reclamation concerning the renewal application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. PUBLIC NOTICE

SURFACE MINING BLASTING SCHEDULE

In compliance with Section 816.64 of the Virginia Coal Surface Mining Reclamation Regulations, notice is hereby given that Pigeon Creek Processing Corporation, having been issued Surface Mine Permit No. 1301769 located at Stonega in Wise County, Virginia, will be conducting blasting on the area covered by the permit. Blasting will be in accordance with all applicable State and Federal laws and will commence according to the following schedule of dates and times, as approved by the regulatory authority:

Access to the blasting area will be controlled to prevent unauthorized entry at least ten (10) minutes prior to any blasting event. A warning signal, indicated by three long blasts on an air horn, will be sounded to clear the area. Then another warning signal indicated by two long blasts on an air horn, two minute delay, then one long horn blast prior to the blasting and an all-clear signal indicated by three short blasts will be audible within a range of one-half mile from the point of the blast in accordance with applicable State and Federal laws.

Also, blasting will not be conducted at times other than those announced except in emergency situations where rain, lightning, atmospheric conditions, or operator or public safety requires unscheduled detonation as approved by the regulatory authority.
