In execution of a Deed of Trust dated August 9, 1995, recorded in Deed Book 807, page 694, in the Clerk’s Office of the Circuit Court of the County of Wise, Virginia, the undersigned Trustee, will on May 23, 2014, at 8:30 a.m., at the front doors of the Courthouse of Wise County, Virginia, offer for sale at public auction to the highest bidder the following property:

All those four certain lots or parcels of land situate, lying and being in or near the Town of Big Stone Gap, Wise County, and more particularly designated and described as follows:

Lots Numbered 68 and 69 as shown upon a map or plat known and designated as “Map Showing Sub-division of the L. M. and Mary Bledsoe 9 and 33/100 acre tract of land one (1) mile East of the Southern Depot, Big Stone Gap, Virginia”, and,

Lots Numbered 70 and 71 as shown upon a map or plat designated “Replat of Bledsoe Addition, Big Stone Gap, Virginia, dated March 12, 1956, which said plats are of record in the Clerk’s Office of Wise County, Virginia, and to which reference is here made for a more complete description of said lots or parcels of land.

Being the same property Carol Clemons acquired by Deed of Gift dated August 18, 1989, from Mildred Aileen Emmett Alsup and William N. Alsup, Jr., her husband, of record in the Circuit Court Clerk’s Office of Wise, County, Virginia, in Deed Book 682, page 701.

This sale is subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the Deed of Trust.

Deposit of 10% of the purchase price, by cash or certified check shall be required of the highest bidder, except from the Noteholder. Deposit, without interest, is applied to the purchase price at settlement. Settlement will be held on or before 15 days after sale, but may be extended in the discretion of the Trustee. Upon purchaser’s default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser. In the event the Trustee cannot convey to the purchaser marketable title, in the Trustee’s sole discretion, the sale may be rescinded and the purchaser’s sole remedy shall be the refund of the deposit.

The balance of the purchase price shall be in cash or its equivalent. Settlement shall be at the office of the trustee or other mutually agreed location. The property and any improvements thereon shall be sold in “as is” condition without any warranties. The successful bidder shall assume all loss or damage to the property from and after the time of the sale. Purchaser shall be responsible for all costs of the conveyance, which shall be by special warranty, including but not limited to the preparation of the deed and the grantor’s tax. The sale is subject to such additional terms as the Trustee may announce at the time of sale. The purchaser will be required to sign a memorandum of sale incorporating all the terms of the sale.

The Virginia Department of Health has under consideration a request for a Categorical Exclusion from an Environmental Assessment for a waterworks project proposed to be funded through the Virginia Water Supply Revolving Fund. The applicant is the Town of Coeburn.

Project Description: The project is located in the Town of Coeburn, Virginia and areas served by the Town of Coeburn public waterworks. Approximately 3,400 linear feet of 4 and 2-inch diameter water line, 27 service reconnections, and related appurtenances will be replaced in the areas of Beech Ave., Gross Dr., Mount Ave, and SR 658 east of its intersection with US Rt. 71. All water line replacement will occur in the area of existing water lines which are mainly located within the limits of existing water line easements, road right-of-ways, and/or previously disturbed areas.

The applicant feels that the project meets the following exclusion categories established by the Department: Water line replacement/rehabilitation to correct exfiltration water loss problems or problems associated with inadequate water pressure.

Documentation supporting this request includes: March 18, 2014 Categorical Exclusion request prepared by The Lane Group, Inc. and March 19, 2014 FCAP Environmental Review site visit documentation.

Prior to implementing construction, the applicant will obtain all applicable permits and approvals. On the basis of a review of the request and support documentation, the Virginia Department of Health proposes to approve the request.

Persons may comment in writing to the Department on the proposed approval of the Categorical Exclusion within 30 days from the first publication date. Comments shall include the name, address, and telephone number of the writer and shall contain a complete, concise statement of the factual basis for the comments. Only those comments received within this period will be considered by the Department. Following the comment period, the Department will make its determination regarding the approval.

Mill Branch Coal Corporation, of 5703 Crutchfield Drive, Norton, Virginia 24273 is applying for revision 1009176, the renewal to DMLR Permit Number 1202113. The mine site is located in Wise County approximately 3.5 miles southwest of Appalachia, Virginia near Exeter. The permit area is located on the Appalachia 7.5 minute quadrangle map at coordinates North 4,016,858 and East 10,218,968 i.e. Latitude 38°16’26” and Longitude 82°54’14”. All drainage will pass through approved sediment control structures and then be discharged into Laurel Fork and Pigeon Creek, of the Powell River.

A copy of the revision application material is available for public inspection and comment at the office of the Circuit Court Clerk, Wise County Courthouse in Wise, VA. A copy of the draft NPDES permit and fact sheet is available for public inspection and comment at the Division’s Big Stone Gap office. Any person whose interests are or may be adversely affected by the proposed revision application, or Officer or Head of any Federal, State, or Local Government agency or authority may within 30 days of May 23, 2014 submit written comments or objections to the Division of Mined Land Reclamation concerning the revision application; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.

The Jenkins Independent School District has been granted tentative authority by the Kentucky Department of Education to dispose of, as surplus property, the McRoberts Elementary School property located at 55 B Ball Drive, McRoberts, Kentucky 41835.

The Jenkins Independent Board of Education has chosen to the sell the property by accepting sealed bids.  Sealed bids will be accepted until 4:00 pm (EST) on the 28th day of May, 2014.  The property will be sold "as is". [Playground equipment is not part of the property and security system will be removed upon sale]

The Board of Education reserves the right to reject any or all bids.  Also, final sale of the property will be subject to final review and approval of the Kentucky Department of Education.
