Nine Mile Spur LLC is applying for bond reduction on Increment 7 of Permit No. 1601876 located in Wise County approximately 5.0 miles north of Appalachia. This permit consists of 197.32 acres which are bonded for $692,500.00 in the form of insurance surety. As provided by 4 VAC 25-130-800-40 of the Virginia Coal Surface Mining Reclamation Regulations, the applicant is requesting a total bond reduction of $232,800.00. (Bond reduction on Increment 7 (45.36 acres) and deletion of Increment 3 (47.51 acres).
This bond reduction request on Increment 7 is based on completion of a minimum of 2 full growing seasons and the following reclamation:
1. Backfilling and regrading, topsoil placement and vegetated.
2. Reclamation completed 8-30-05.
3. All areas have been stabilized and drainage control established.

IN THE MATTER OF:

The Department of Mines, Minerals, and Energy, Division of Mined Land Reclamation, of the Commonwealth of Virginia, pursuant to the authority granted in the Virginia Coal Surface Mining Control and Reclamation Act of 1979 (Chapter 19, Article 4, Section 45.1-260 et seq.,) with funding provided by the 2011 Consolidated Grant, has determined and found that:
Land located on Locust Grove Road off of Rt. 640 in Wise County, Virginia, has been adversely affected by past coal mining practices, to wit:
1. Property owners, both known and unknown, are hereby notified of the Division’s intention to reclaim the area adversely affected by past coal mining practices. The purpose of this Notice is to provide notice to any landowners, heirs, assigns and devisees who may be affected by the proposed reclamation and who have not been identified and who have not granted written consent.
2. The public health, safety and property is endangered by: traffic hazards that results from mine drainage.
3. The proposed action consists of:
Excavation of the seepage area. Traffic on Locust Grove Road may be stopped for brief periods of time.
Installation of drainage structures to capture and convey the drainage to existing road ditches.
Repaving sections of Locust Grove Road that are affected by this work.
Standard erosion and sediment control measures will be implemented throughout the duration of this project.
